Thanks for checking out our OneAppStopPrivacy Policy.  When using our Services, please be aware that this Privacy Policy controls our practices with respect to our collection, use, processing and onward transfer of data gathered in connection with your use of our Services.  If you use our Services, whether through our website or by downloading and/or installing our applications, you agree and consent to the collection, use, processing and transfer of any data gathered about you by us in accordance with this Privacy Policy.  If you do not agree, you are prohibited from using our Services.  References herein to the “Company”, “OneAppStop”, “we”, “us”, or “our” refers to OneAppStop.  To the extent we use capitalized terms that are not defined in this Privacy Policy, we refer you to the Terms of Service available at https://oneappstop.com/legal#terms-of-service (the “TOS”) for such defined terms.

Section 1.  Purpose.

We have developed this Privacy Policy to describe our practices with respect to the collection, retention, processing and sharing of information gathered as a result of your use of and interaction with our Services.  These Services include our search and discovery Apps.  Our Privacy Policy sets forth both your and our rights with respect to accessing, modifying, deleting and sharing of information about you in certain circumstances.  Before using our Services, you are encouraged to read this Privacy Policy in its totality so that you can select your privacy preferences in connection with your use of our Services in an informed and educated manner.

Section 2.  Summary.

With respect to our information collection and usage practices, this Privacy Policy controls as to the Services we provide.  We collect both Personal Information and Non-Personal Information about you in connection with your use of our Services.  Generally, “Personal Information” means information about you that is capable of personally identifying you, including information you may provide to us.  Personal Information includes things like your name, address, phone number, email, and other information, such as billing information.  Personal Information does not include Log Information or Device Information (each as defined below).  On the other hand, “Non-Personal Information” means information that does not specifically identify you and Device Information and Log Information, such as data related to the searches you perform utilizing our search functionality.  Personal Information and Non-Personal information about the users of our Services, like you, is referred to herein as “End User Information.”  We may use your End User Information in connection with providing you with our Services and as otherwise set forth herein.

Collection of Information

Your End User Information is collected by us in a number of ways, including:

  • information you provide us when using or registering to use our Services;
  • information accessible from your computer system or mobile device as a result of accessing the Services or downloading a portion of the Services onto such computer system or mobile device; and
  • information gathered from third parties, to the extent such third party has the right to share such information with us.

Your End User Information may be any combination of Personal Information and Non-Personal Information. An example of the Personal Information we may collect includes your name and email address, which Personal Information is collected by us in connection with registration for our Services.  An example of Non-Personal Information we collect includes information generated by your access and use of our Services, such as the device ID or the IP address from which you access our Services.  We may also collect information pertaining to your use of our Services, including search queries you may initiate when utilizing the search functionality made available through our Services, as well as the types of Service Content that you interact with when using our Services.

Retention of Information

Your End User Information is retained by us only as long as we deem necessary in order for us to provide the Services to you and to otherwise utilize your End User Information for the purposes outlined in this Privacy Policy.

Processing of Information

We have a number of reasons for collecting, processing and sharing your End User Information, including:

  • to provide the Services, 3rd Party Services, advertising and Service Content to you, either directly or indirectly through a third party;
  • to improve our Services, our business and/or 3rd Party Services, as well as the offerings and advertising of our clients and advertisers;
  • to comply with applicable laws and other legal process;
  • to prepare reports and other analytical insights that may be important for the operation and/or expansion of our business; and
  • to ensure that you are using our services in conformity with the TOS.

Sharing of Information

We will not share your End User Information with third parties, including our affiliates, if there is not a valid and binding agreement in place with such third parties to abide by the terms of this Privacy Policy with respect to such End User Information and/or where we have contractually agreed that we will not share such End User Information.  If there is a valid agreement in place, we may share your End User Information with certain third parties, such as our affiliates, advertising clients, technology partners, and certain third parties that provide a portion of the Service functionality, including 3rd Party Services, such as our search functionality. 

Accessibility of Information

Certain privacy and data protection laws provide the end user with the right to inspect, modify, delete, and/or restrict the types of End User Information that we collect, as well as to be informed about the third parties with which we have shared your End User Information.

Section 3. Collected Information

We collect information, including your End User Information, in a number of ways.  Your End User Information may either be Personal Information or Non-Personal Information.

Automatically Collected Information

We collect a lot of the information generated from your installation and use of our Services.  Most of this information is Non-Personal Information, including Device Information and Log Information (each as defined below), and information derived from cookies or other similar technologies. Information about your computer, mobile device or other technology used to access and use our Services, including the hardware model and the software systems on such device, is referred to herein as “Device Information.”   

“Log Information” is information we collect from our server logs and is obtained in connection with the use of our Service, and may include the following:

  • your IP Address (Internet protocol address);
  • your Internet service provider’s (ISP) domain name;
  • the Internet location from which use of our Services was launched and/or terminated;
  • the date and time of your interactions with our Services,
  • information about your device, such as hardware settings, browser language, system activity, crash event, and the date and time of your request and referral uniform resource locator (URL), in connection with your use of our Services.
  • your geographic information (latitude and longitude when you access our Services),
  • your search activity in connection with your use of our search functionality (the search terms you enter),

Information Provided by You

We collect the information you provide us when you use our Services, including your Personal Information, such as your name, username and password, address, email address telephone number, among other information you may provide. The information we collect may also include information, including Personal Information, that we acquire from third parties as a result of your use and/or installation of our Services.  For example, if you use social media login credentials (such as Facebook) to register for our Services, we may collection information made available to us by Facebook in connection with such registration.  To the extent you have also provided us with Your Content, such as photographs and other content, we may also collect and retain any of your End User Information submitted in connection with the provision of Your Content.

Information Provided by Other Technologies

Unless you have opted out, we may also use information derived from other generally available Internet technologies, including web beacons, pixels and cookies.  Information supplied by these technologies provide us with additional information about your use of the Internet generally, such as websites you have visited, the time and dates of such visits, the content or types of content you interact with on such websites, and your interactions with online advertising.

Information Provided by Third Parties

We may be provided with End User Information about you from third parties such as service providers, affiliates, 3rd Party Service providers, partners, and advertisers to the extent we have an agreement in place with such third parties to make information about you available to us.  The information provided by such third parties may be either Personal Information or Non-Personal Information.  In cases such as this, how these third parties gather and pass along this End User Information to us is governed by the privacy policies of the applicable third party.

Section 4. Our Use of your End User Information  

Your End User Information, however obtained by us, will be used by us for a number of purposes, including to provide and improve our Services, to assist our service providers, affiliates, 3rd Party Service providers, partners, and advertisers in providing their products and services, and for advertising the goods and services of others on or through our Services or on other applications, websites, and/or extensions.

Specifically, your End User Information will be used:

  • to provide, maintain, develop, and improve our Services, our business, our Service Content and our features, including in conjunction with 3rd Party Service providers we have contracted with to provide our search functionality;
  • to share your End User Information with third parties to the extent needed to provide you with the Services, functionality available through the Services, 3rd Party Services, and advertisements and other Service Content that is specific to you based on your End User Information and preferences and/or may otherwise be of interest to you;
  • for purposes of preparing analytical insights and reports related to our business, which reports may contain aggregated or anonymized information;
  • to respond to you through contact information you have provided us, such as text or email for purposes of responding to your inquiries and requests;
  • to comply with applicable laws and other legal process; and
  • to ensure proper use of our Services, including in accordance with our TOS.

We may combine your Personal Information with Non-Personal Information and other information we may obtain from third parties when we utilize your End User Information for any of the above purposes and other uses of your End User Information for legitimate business purposes, as permitted by this Privacy Policy.  When Non-Personal Information and Personal Information is combined, we treat such combined End User Information as Personal Information for purposes of our undertaking in this Privacy Policy.

When you perform searches utilizing the search functionality of our Services, we retain information related to the searches you perform, including your search terms.  We use this information to ensure that our Services are performing correctly, as needed to comply with applicable law, and for purposes of confirming contractual compliance by our search functionality provider.  We never combine such information with any Personal Information.  We do not use information obtained in connection with your use of search services available through the Services for ad targeting, retargeting, audience creation or any other similar ancillary purpose not directly related to the core functionality of our search and discovery Apps.

Section 5.  Sharing Your End User Information

Unless set forth in this Privacy Policy, we do not share or provide your Personal Information to any third party outside of the Company and its affiliated entities.  Where we do transfer your End User Information, we do so in compliance with all applicable privacy and data protection laws.

We may share your End User Information, including your Personal Information,  (i) with our Affiliates (except for those we have contractually agreed to not share your End User Information), (ii) to facilitate the function of 3rd Party Services, (iv) to prevent fraud or illegal activities, (v) to advertisers and advertising networks we may work with from time to time, (vi) in connection with a sale or merger of us with another party, and/or (vii) as otherwise required by applicable law. As used herein, “Affiliates” includes our parent company and entities under common ownership or control of our ultimate parent company.

In addition to the above, if necessary to protect the safety, rights, or property of us, our users, or others, including our business partners and/or to investigate, prevent, or respond to suspected illegal or fraudulent activity, we may share your End User Information, including your Personal Information.  To the extent that law enforcement authorities, courts, or regulators, request information or we are otherwise required to disclose information to comply with the law or to meet national security or law enforcement requirements, we may disclose any information we have about our users, including you and your Personal Information.  We may disclose information collected about our users, including your End User Information, in connection with the protection and/or exercise of our legal rights and interests.

We disclaim and shall have no liability or obligation in connection with any third party actions or omissions concerning your End User Information, including your Personal Information, even if such information was obtained from us in accordance with this Privacy Policy.  You are encouraged to contact the applicable third party if you experience any issues with respect to such third party’s use of your End User Information.

We may share your End User Information, including your Personal Information, to the extent necessary for third parties assisting us with the provision of the Services to assist us in in that regard or as necessary to provide their own 3rd Party Services.  In such cases, we have entered into contracts with these third parties, including vendors, business partners and service providers or have otherwise taken steps to prohibit or limit them from sharing your End User Information, except as necessary to perform on our behalf or in accordance with applicable law.  Information about you, including information related to your use of our search functionality, that such third parties gather as a result of your use of their 3rd Party Services is subject to the applicable third party’s terms of use and privacy policy. 

We also reserve the right to transfer your End User Information to a third party in connection with a sale or merger of our business or parts thereof pertaining to our Services and/or your End User Information (e.g., a sale, merger, or other transfer of assets), or in connection with a corporate restructuring.

Lastly, many of our Services are supported by advertising that appears on or through our Services.  We may share your End User Information with those advertising networks and advertisers we have partnered with for these purposes.  These companies may also collect information about you, including Personal Information and Non-Personal Information, in connection with your use our Services and any of their 3rd Party Services incorporated into such Services. Similar to us, such third parties may also use cookies and other technologies to collect information about you when you visit our site as described below.  The applicable terms of use and privacy policy of such advertisers and advertising networks shall apply to all information about you that such advertisers and advertising networks gather about you in connection with your use of our Services.

A “cookie” is a small file containing your preferences that is sent to your browser and sent back by your browser each time your browser accesses our servers.  We use the term “cookies” in this Privacy Policy to refer to cookies and all such similar technologies that collect information automatically when you are using our Services.  We may send your computer or mobile device a cookie or pixel or beacon or other technology that uniquely identifies your browser in connection with the use of our Services. We use cookies and the data derived from such cookies to improve the quality of our Services and your use of those Services, such as to deliver our Services and Service Content in your language of choice, to filter results and deliver the Services in accordance with your preferences, and to analyze your interaction with our Services.  The cookies we use can only be read by the server that placed them there.  Many browsers are set up to accept cookies unless the user changes the settings for cookies.  By properly setting your preferences in your browser, you can control which and what types of cookies are downloaded from the Services. We may utilize web analytics companies to assist us in measuring the effectiveness of our Services in certain instances.  We allow these third parties to include their own cookies on the Services when we do so. These web analytics companies collect information including click-throughs by users and other similar information from cookies. This information is used by us to improve our Services, including by understanding overall user preferences, click-through rates, and the types of offers that are of most interest to our users. Although this information is collected by third parties, it is done on our behalf and we retain control over the use of such information, which shall be deemed part of your End User Information for purposes of this Privacy Policy.

Common ID Cookie

Certain of our sites comprising a portion of the Services may also use cookies and similar tracking technologies such as the Common ID cookie. The Common ID cookie stores a unique user id in the first party domain and is accessible to our ad partners. This simple ID that can be utilized to improve user matching, especially for delivering ads to iOS and MacOS browsers. These cookies are important devices for measuring advertising effectiveness and ensuring a robust online advertising industry. Nevertheless, you can opt out of the Common ID tracking cookie by disabling cookies in your browser.

Section 7. Information Retention 

We retain information collected about you generally only as long as is necessary for us to fulfill our business purposes.  However, we may retain this information for a longer period if required to comply with law or a legal request.  We may choose to anonymize certain information you provide to us in certain circumstances, specifically Personal Information, so that it can no longer be attributed to you if we would like to retain it for longer periods of time.

Section 8. Privacy Practices of Third Parties

It may be necessary or desirable for you to provide your End User Information, including Personal Information, to third parties, such as providers of 3rd Party Services, or to download certain software from such third parties in connection with your use of our Services. While applicable law obligates third parties engaged by and/or working with us to protect the privacy of certain types of data, we assume no responsibility for the actions or omissions of these third parties, whether they receive such information from us directly or otherwise.  We disclaim all liability and assume no responsibility for the privacy practices of third parties, or the contents of any software downloaded from them.  Any questions you have about such third parties’ privacy practices and/or software should be directed to such third parties.

Section 9. Data Protection 

We maintain technical, physical, and administrative security measures designed to provide reasonable security for the information we collect and retain, including your End User Information. The security measures include physical access controls to data centers we use, the use of firewalls, data encryption, and information access authorization controls. Notwithstanding the precautions we take to prevent possible data breaches in our Services and databases, we cannot guarantee that your End User Information will remain completely secure. There can be no assurance that unauthorized hacking, access, data loss, or other breaches will never occur and disclaim all liability in connection with any such activities.  Your use of our Services is at your own risk. Notwithstanding our dedication to securing our systems and Services, you remain responsible for securing and maintaining the privacy of your password, if any, used in connection with your use of our Services. You should protect your Personal Information when you are on the Internet, including making sure you use a secure Internet browser.

We comply with the Children’s Online Privacy Protection Act; for more information the Act and children’s privacy, please visit http://www.ftc.gov/privacy/coppafaqs.shtm. Our Services are not directed to children under the age of 13 (under 16 in the EEA).  In the event that we obtain actual knowledge that we have collected Personal Information from a child under the age of 13 (under 16 in the EEA), we will promptly delete it, unless we are legally obligated to retain such data. Please contact us immediately if you believe that we have mistakenly or unintentionally collected information from a child under the age of 13 (under 16 in the EEA). 

Section 11. International Usage and Data Transfers 

You understand and agree that we make no representation and/or warranty that our Services are legal, appropriate, or available for use in any particular jurisdiction. If you decide to access our Services, you do so at your own risk.  You are solely responsible for complying with all local laws, rules and regulations pertaining to the use of our Services. Notwithstanding the foregoing, we reserve the right to limit access to our Services, in whole or in part, to any person, geographic area or jurisdiction we choose, at any time and in our sole discretion, including to the extent we believe that they use of our Services is illegal in an applicable jurisdiction.

Our Services are provided from servers and systems located within the United States.  If you are not located in the United States, you should be aware that we will transfer your information, including your Personal Information, to the United States where many of our central databases operate.  By using our Services, you consent to such cross-border data transfers of your Personal Information and agree to your Personal Information being collected, processed and transferred as set forth herein and in accordance with U.S. law. The data protection laws and other laws of other countries, such as the United States, may provide a less comprehensive or protective standard of protection than those in your country.  We have entered into Standard Contractual Clauses (SCC) pursuant to 2001/497/EC between us and the applicable third party we are transferring your information to in all appropriate cases.  If you are an EEA resident, you may request a copy of these agreements by contacting us as indicated in Section 16 below.

Section 12. Accessing, Reviewing and Changing Your Personal Information.

Generally

Depending on what country (countries located in the European Economic Area for instance) or state (California or Virginia for instance) you are located in, you may have certain legal rights in relation to your Personal Information. You may have the right to request access to your Personal Information that we retain, as well as to seek to update, delete or correct this Personal Information, subject to certain exemptions provided by law.  Please contact us via email at [email protected] you wish to exercise your rights.  We cannot guarantee that you will be given access to your Personal Information in all circumstances, except those mandated by law.  Additionally, if we are unable to verify your identity or are required to retain certain of your information by law, we may not be able to modify or delete your Personal Information, but will do so in all cases required by applicable law.

California Residents

Under California Civil Code Section 1798.83, which is also known as the “Shine The Light” law, users who are California residents may request from us a list of the Personal Information (if any) that we have disclosed to third parties for direct marketing purposes during in the preceding calendar year, this includes the names and addresses of such third parties. Requests may be made only one time per year. These requests are free of charge. In the body of such request, you must put the statement “Your California Privacy Rights”, as well as your name, street address, city, state and zip code and you must provide enough information for us to determine if this applies to you. If you are a resident of California, you have certain additional rights under the California Consumer Privacy Act of 2018 (CCPA), including the right:

When you assert your right to request information, you must confirm that you are a resident of the State of California.  We reserve the right to request that you provide further evidence as a resident of California before acting on your request.

Section 13. Updates and Amendment to this Privacy Policy

This Privacy Policy may be updated or modified by us at any time and for any reason by posting a revised version of this Privacy Policy on the Services and/or in accordance with the other methods established in the TOS. You shall be deemed to have unconditionally accepted this Privacy Policy, as so updated, if you continue to use our Services after any such update. This Privacy Policy is not applicable to 3rd Party Services or other third party services available on or through the Services.
